Neighborhood business district C 10' 5' 5' 40' Any Res District There shall be provided a minimum setback line for a building or structure in the neighborhood business district on a corner lot (or parcel) of ten feet from the front lot line, ten feet from the side street lot line and five feet from the rear and interior lot lines. Parking. Off-street parking for a building or structure in the neighborhood business district shall be provided for one vehicle for each 250 square foot of gross floor area. The number of handicap parking spaces shall be established in accordance with the Americans with Disabilities Act.
Highway commercial district C-2 Front yard building lines shall conform to the average building in a developed block but in no case shall it be less than ten feet from the property line to include one tree for every 25 feet of lot frontage. Riverfront district C-3 10' 10' 10' 40' There shall be provided a minimum setback line for a building or structure in the riverfront district on a corner lot (or parcel) of ten feet from the front lot line, ten feet from the side street lot line and five feet from the rear and interior lot lines. Parking. Off-street parking for a building or structure in the riverfront district shall be provided for one vehicle for each 400 square feet of gross floor area. The number of handicap parking spaces shall be in accordance with the Americans with Disabilities Act.
Marina district Mar 20' 5' 5' 40' Since a marina is a commercial venture, costs for all town services, i.e., water, sewerage, garbage, natural gas, etc., shall be charged at the appropriate commercial rate. The owner/operator must apply for and obtain an occupational license from the town. single-family dwellings. Construction of a single-family dwelling in the this district must be in compliance with all of the town's permitting requirements, building code, setback and height regulations for a single family residence, as well as the town's floodplain ordinance. There shall be provided a minimum setback line for a building or structure in the marina district on a corner lot (or parcel) of 20 feet from the front lot line, ten feet from any side street lot line and five feet from the rear and interior lot lines

Elevation requirements for certain flood zones:

(a) Any building or structure in flood zone A13 having a required elevation of 12 feet (A13 (11)) shall not exceed 40 feet in height measured from the highest, adjacent grade to the highest point of any permanent part of the structure. A permanent part of a structure shall include any addition to the structure secured by any means which did not otherwise appear in any document submitted to the town for approval. Consistent with the foregoing, and in the following flood zones, the corresponding maximum heights of the highest, point of any permanent part of the structure shall be as follows:

(1)Flood Zone A13 (12): 41 feet.

(2)Flood Zone A13 (13): 42 feet.

(3)Flood Zone V15 (14): 43 feet.

(4)Flood Zone V15 (15): 44 feet.

(5)Flood Zone V15 (16): 45 feet.

(b)In no instance shall the maximum height of the highest point of any permanent part of the structure exceed 45 feet.

(c)This section shall be applicable to all subsequent amendments to the flood insurance rate maps which may reflect different zone designations and corresponding elevations from the present maps. As required by the safety code regulations, fireplace chimneys shall not extend more than three feet above the highest point of any permanent part of the structure as may be required by the building code.


The term "construction fill" means a volume of earthen material that is required to be placed and compacted, to at least 95 percent compaction per state building codes, for structural foundations. Fill material may include soil, aggregate, rock and concrete that is placed no more that 12 inches above natural grade beneath a structure. Fill for driveways and patios can be no more than six inches above natural grade.

Private wells prohibited. It shall be unlawful for any person, firm, or corporation within the corporate limits of the town to drill, drive or sink a water well as long as the town maintains a central water system. Private Sewer is fine.
