Residential Certificate of Occupancy Request
No land disturbance permit, either tier 1 or tier 2, is required for clearing and/or grubbing private residential property associated with construction of a residential structure that disturbs less than four thousand (4,000) square feet, if outside a special flood hazard area.
Please note that the City of Mobile encourages a minimum, one-foot, freeboard above FEMA required BFE based upon the most restrictive flood zone delineated within the property and that all equipment must also be elevated to this level.
In special flood hazard areas without base flood elevation data, new construction and substantial improvements of existing structures shall have the lowest floor (for the lowest enclosed area; including basement) elevated no less than three (3) feet above the highest adjacent grade.
Where base flood elevation data is available, new construction and substantial improvement of any structure or manufactured home shall have the lowest floor including basement, elevated to the base flood elevation unless the city is granted an exception by the administrator for the allowance of basements in accordance with CFR title 44, volume 1, sec. 60.6(b) or (c). Should solid foundation perimeter walls be used to elevate a structure, openings sufficient to facilitate the unimpeded movements of flood waters shall be provided in accordance with standards of subsection 17-27(4).
-Proposed new construction and substantial improvements that are partially located in an area of special flood hazard shall have the entire structure meet the standards for new construction. -Proposed new construction and substantial improvements that are located in multiple flood hazard risk zones or in a flood hazard risk zone with multiple base flood elevations shall have the entire structure meet the standards for the most hazardous flood hazard risk zone and the highest base flood elevation.
Fill within the area of special flood hazard shall result in no net loss of natural floodplain storage. The volume of loss of floodwater storage due to filling in the special flood hazard area shall be offset by providing an equal volume of flood storage by excavation or other compensatory measures at or adjacent to the development site. Any excavation or other measures taken for compensatory storage shall be properly designed to provide protection against erosion or overgrowth of vegetation in order to preserve the storage volume. Proper maintenance measures shall also be undertaken to ensure the intended storage volume remains in perpetuity. AKA Do not fill within or alter a Special Flood Hazard Area (floodplain) without an engineered flood study (Base Level Engineering) or violate any of the requirements in Division 2 of the Stormwater Management and Flood Control Ordinance specifically.
Sidewalk Waiver Information If you are constructing a new house, you are required by the Subdivision Ordinance to construct sidewalk; however, if you wish have this requirement waived, an administrative sidewalk waiver may be applied for on your land disturbance permit. Waivers are typically approved in areas where the residential neighborhood is built out and sidewalk does not currently exist. All storm drain pipe installed in the City of Mobile ROW, Public Easement, or carrying City of Mobile system stormwater shall have the joints wrapped with filter fabric, shall have no lifting holes (filling lifting holes is not allowed without explicit approval), shall be a minimum of 15 inch in diameter, and shall be Class III or stronger reinforced concrete pipe (RCP). The contractor needs to notify the pipe manufacturer ahead of time that the project is within the City of Mobile ROW to obtain pipe without lifting holes. Storm drainage connections shall occur at the junction box or inlet. If there is not an existing inlet or junction box to connect to, then one shall be constructed in accordance with relevant ALDOT Standard and Special Drawings
